Terms of Service

Effective Date: 16 July 2025

This Terms of Service ("Agreement") is a binding contract between you ("Client", "User", "You") and HostNinza.com, a brand operated by Cvacore Technologies Private Limited ("We", "Us", "Company"). By accessing or using our website and services, you agree to be bound by these terms. If you do not agree, you must not use our services.

1. Scope of Services

HostNinza provides a variety of online infrastructure services, including but not limited to:

• Shared, Reseller, Business, and WordPress Hosting
• Virtual Private Servers (VPS) and GPU-Accelerated Cloud Servers
• Dedicated Servers and Custom Cloud Infrastructure
• Domain Registration, Renewal, and Transfers
• Third-Party Licensing (e.g., cPanel, LiteSpeed, WHMCS)
• Managed Server Setup, Security Hardening & Consulting

2. Account Registration & Security

• You must be at least 18 years old or legally eligible to form a binding contract in your jurisdiction.
• You agree to provide accurate, current, and complete account information.
• You are fully responsible for maintaining the confidentiality of your login credentials.
• All activity under your account will be considered your responsibility, whether authorized or not.

3. Acceptable Use Policy (AUP)

Clients must comply with our Acceptable Use Policy. The following are strictly prohibited:

• Hosting of pirated, abusive, or illegal content
• Sending spam, phishing, or malicious code
• Involvement in DDoS attacks or network abuse
• Cryptocurrency mining without explicit permission
• Use of services in violation of local or international law

We reserve the right to suspend or terminate services for any AUP violation without notice or refund.

4. Payments, Renewals & Billing

• All services are prepaid unless stated otherwise.
• Payments must be completed by the due date to avoid suspension or termination.
• Recurring services will be automatically renewed unless cancelled prior to the renewal date.
• Invoices are issued in INR or USD as applicable. GST applies as per Indian laws.

5. Refunds & Cancellations

Refunds are governed by our Refund and Cancellation Policy. Summary:

• 7-day refund available on shared hosting plans only if a valid issue remains unresolved.
• No refunds on domains, VPS, dedicated servers, licenses, or one-time setup services.
• Cancellations can be requested anytime, but unused portions are non-refundable unless within the refund window.

6. Domain Registration

• Domains are registered via ICANN-accredited registrars; their policies also apply.
• Once registered, domains cannot be refunded or altered.
• You are responsible for renewing domains before expiry to maintain ownership.

7. Uptime Commitment

We strive to maintain 99.9% uptime across all hosting platforms. This does not include:

• Scheduled maintenance
• Outages beyond our control (e.g., upstream data center issues)
• Client-caused errors or misconfigurations

No service credit will be issued unless under a formal SLA agreement.

8. Backups & Data Protection

• We may provide courtesy backups, but the client is responsible for their own data backups.
• Data recovery is not guaranteed unless a paid backup solution is subscribed.

9. Third-Party Services & Integrations

We integrate third-party software and services (e.g., Cloudflare, Softaculous, Imunify, etc.). These are governed by their own terms, and we are not liable for their performance, downtime, or pricing changes.

10. Service Termination

We reserve the right to suspend or terminate your service in the following cases:

• Non-payment beyond 5 days of invoice due date
• AUP violations or legal takedown notices
• Chargebacks or fraudulent transactions

No refund will be provided if termination is due to policy or legal violations.

11. Limitation of Liability

To the maximum extent permitted by law, HostNinza and its affiliates shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, goodwill, or reputation
• Any claim exceeding the amount paid by you for the service in the last 30 days

12. Indemnification

You agree to defend, indemnify, and hold harmless HostNinza, its directors, employees, and legal owners (Cvacore Technologies Pvt. Ltd.) from any third-party claims, actions, or damages resulting from your use of our services or violation of any applicable law or terms.

13. Intellectual Property

• All content, branding, code, design, and trademarks on HostNinza.com are owned by Cvacore Technologies Pvt. Ltd. or its partners.
• Unauthorized use, reproduction, or redistribution is strictly prohibited.

14. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Republic of India. All disputes shall be subject to the exclusive jurisdiction of courts located in Patna, Bihar.

15. Changes to Terms

HostNinza reserves the right to modify these Terms of Service at any time without prior notice. It is your responsibility to check this page periodically. Continued use of our services constitutes acceptance of the modified terms.
